DEFAULT having been made in the payment of the indebtedness described in and secured by that certain mortgage executed by DALE A. CLEMMONS and KIMBERLY CLEMMONS, husband and wife, as Mortgagor(s) to Mortgage Electronic Registration Systems, Inc., acting solely as nominee for M & T Bank, as Mortgagee, dated the 23rd day of April, 2007, and recorded in RLPY Book 2007, Page 33408, et seq. of the records in the Office of the Judge of Probate Court of Limestone County, Alabama; said mortgage being lastly assigned to NEW PENN FINANCIAL, LLC d/b/a SHELLPOINT MORTGAGE SERVICING by instrument recorded in said Probate Court records; said default continuing, notice is hereby given that the undersigned will, under and by virtue of the power of sale contained in said mortgage sell at public outcry for cash to the highest bidder during legal hours of sale, on the 7th day of September, 2017, in the city of Athens, at the front Door of the Court House of Limestone County, Alabama, the following described real property situated in the County of Limestone, State of Alabama, to-wit:

THENCE FROM POINT OF BEGINNING CONTINUE NORTH 33 DEGREES 09 MINUTES 00 SECONDS EAST ALONG THE CENTER OF WEST LIMESTONE SCHOOL ROAD FOR A DISTANCE OF 139.72 FEET TO A RAILROAD SPIKE; THENCE NORTH 33 DEGREES 26 MINUTES 00 SECONDS EAST ALONG THE CENTER OF SAID WEST LIMESTONE SCHOOL ROAD FOR A DISTANCE OF 491 .30 FEET TO A POINT; THENCE NORTH 56 DEGREES 34 MINUTES 00 SECONDS WEST FOR A DISTANCE OF 113.40 FEET TO AN IRON PIN, PASSING AN IRON PIN ON THE WESTERLY RIGHT OF WAY MARGIN OF SAID WEST LIMESTONE SCHOOL ROAD AT A DISTANCE OF 25.0 FEET; THENCE SOUTH 33 DEGREES 26 MINUTES 00 SECONDS WEST FOR A DISTANCE OF 34.0 FEET TO AN IRON PIN; THENCE SOUTH 54 DEGREES 02 MINUTES 27 SECONDS WEST FOR A DISTANCE OF 412.0 FEET TO AN IRON PIN; THENCE SOUTH 33 DEGREES 26 MINUTES 00 SECONDS WEST FOR A DISTANCE-OF 213.80 FEET TO AN IRON PIN; THENCE SOUTH 57 DEGREES 06 MINUTES 10 SECONDS EAST FOR A DISTANCE OF 259.1 I FEET TO THE POINT OF BEGINNING, PASSING AN IRON PIN ON THE WESTERLY RIGHT OF WAY MARGIN OF WEST LIMESTONE SCHOOL ROAD AT A DISTANCE OF 234.1 I FEET. AND BEING SUBJECT TO: ONE HALF OF THE RIGHT OF WAY OF WEST LIMESTONE SCHOOL ROAD ALONG THE EASTERLY BOUNDARY.



This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, reservations and exceptions reflected in the mortgage and/or those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Said sale will be made for the purpose of paying said indebtedness and the expenses incident to this sale, including a reasonable attorney's fee, and the other purposes set out in said mortgage. The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and also to final confirmation and audit of the status of the loan with the Mortgagee.
