NOTICE OF CITY COUNCIL ACTION This public notice relates to an old 10 wide alley abutting East Street, more particularly described as follows: THAT CERTAIN 10 FOOT WIDE ALLEY LYING BETWEEN TRACT 1-A AND TRACT 1-D OF BLOCK 29, AS SHOWN ON A MAP OF THE CITY OF ATHENS, ALABAMA, AS SHOWN AT PLAT BOOK A, PAGE 17 IN THE OFFICE OF THE JUDGE OF PROBATE OF LIMESTONE COUNTY, ALABAMA (the Public Way). The City Council considered whether the Public Way should be vacated pursuant to the provisions of 23-4-1, et seq. of the Code of Alabama. The City Council conducted a public hearing to address this matter, and then approved a Resolution concerning this matter, at its regular meeting on April 22, 2024, at 4:30 p.m., at the City Council Chambers in the City Hall of the City of Athens, Alabama, located at 200 Hobbs Street West, Athens, Alabama 35611. The City Councils Resolution stated in part as follows: 1. The Public Way is hereby vacated upon the City Clerks filing of this Resolution with the Probate Court of Limestone County. Upon such vacation, the City Council does thereupon divest itself of all public rights and liabilities therein in accordance with 23-4-2(b) of the Code of Alabama, except as may be otherwise stated herein. 2. Upon (a) payment by Scott Marshall of the Citys administrative and legal costs related to the vacation of the Public Way as determined by the City Clerk, and (b) the Citys receipt of a written public utility and drainage easement over the area of the Public Way (which easement shall endure and persist for the benefit of the City after the vacation of the Public Way), in a manner and form that is satisfactory to the Mayor, then the City Clerk shall cause a copy of this Resolution to be filed with the Probate Court of Limestone County. Such filing shall operate as a declaration of the governing bodys vacation and shall divest all public rights and liabilities, including any rights which may have been acquired by prescription, in the Public Way, except as may be otherwise stated herein. 3. Title and all public rights in the Public Way shall vest in the abutting owner(s), to the extent and as provided for by law. 4. However, notwithstanding anything herein to the contrary, any entities (such as the City by and through Athens Utilities) with utility/storm drainage lines, equipment, or facilities in place at the time of vacation, shall have the right to continue to access, maintain, extend, and enlarge their lines, equipment, and facilities to the same extent as if the vacation of the Public Way had not occurred. Moreover, such entities may continue to move across and along the vacated area to reach their lines, equipment, and facilities for the above purposes as if the vacation had not occurred. Upon (a) payment by Scott Marshall of the Citys administrative and legal costs related to the vacation of the Public Way as determined by the City Clerk, and (b) the Citys receipt of a written public utility and drainage easement over the area of the Public Way (which easement shall endure and persist for the benefit of the City after the vacation of the Public Way), in a manner and form that is satisfactory to the Mayor, then the City Clerk shall cause a copy of this Resolution to be filed with the Probate Court of Limestone County. Such filing shall operate as a declaration of the governing bodys vacation and shall divest all public rights and liabilities, including any rights which may have been acquired by prescription, in the Public Way, except as may be otherwise stated herein. 3. Title and all public rights in the Public Way shall vest in the abutting owner(s), to the extent and as provided for by law. 4. However, notwithstanding anything herein to the contrary, any entities (such as the City by and through Athens Utilities) with utility/storm drainage lines, equipment, or facilities in place at the time of vacation, shall have the right to continue to access, maintain, extend, and enlarge their lines, equipment, and facilities to the same extent as if the vacation of the Public Way had not occurred. Moreover, such entities may continue to move across and along the vacated area to reach their lines, equipment, and facilities for the above purposes as if the vacation had not occurred. Additionally, the City shall have such rights as are described in the easement referenced in #2, above. 5. The City Clerk shall cause notice of this action to be published once in the Athens News Courier no later than 14 days after the adoption of this Resolution. A BILL TO BE ENTITLED AN ACT Relating to Limestone County; to provide for the salary of the coroner effective beginning the next term of office; to authorize the coroner to employ assistants; to further provide for the appointment of deputy coroners and the salary of deputy coroners and for this purpose to amend Section 45-42-61 of the Code of Alabama 1975; and to repeal Section 45-42-60 of the Code of Alabama 1975, relating to the coroner. BE IT ENACTED BY THE LEGISLATURE OF ALABAMA: Section 1. (a) In Limestone County, effective beginning the next term of office of the coroner, the salary of the coroner shall be forty thousand dollars ($40,000) per year payable in installments from the general fund of the county. The salary provided by this section shall be the total compensation of the coroner and shall be in lieu of any other compensation, salary, expense allowance, or fees provided to the coroner prior to the effective date of this act. (b) The coroner, by accepting the salary provided by this section or any expense allowance under subsection (b), shall waive any right to any fees or mileage allowance provided to a coroner by general law and the salary provided by this section shall be in lieu of any fees provided by general law. (c) The coroner, subject to approval by the county commission, may employee assistants to serve at the pleasure of the coroner. The salary of any assistants employed by the coroner shall be five hundred dollars ($500) per month. (d) This section shall not affect any expenses paid by the county for the operation of the office of the coroner pursuant to Section 45-42-62 of the Code of Alabama 1975, or otherwise. The county commission may pay any expenses as the county commission determines necessary for vouchered expenses for the operation of the office of the coroner. Section 2. Section 45-42-61 of the Code of Alabama 1975, is amended to read as follows: 45-42-61 In Limestone County, the county coroner, is hereby authorized to subject to approval of the county commission, may appoint a one or more deputy coroner coroners who shall have the same responsibilities as the coroner when the coroner is absent or in some way incapacitated. If the county coroner should for any reason vacate the office, the any deputy coroner shall serve until a successor is appointed or elected. TheA deputy coroner is authorized to shall receive a salary of seventy-five dollars ($75) six hundred dollars ($600) a month to be paid out of the general fund of the county in the same manner as other elected or appointed officials are paid. The salary provided by this section shall be the total compensation of any deputy coroner and shall be in lieu of any other compensation, salary, expense allowance, or fees provided to any deputy coroner prior to the effective date of this act. Section 3. (a) Section 45-20-60 of the Code of Alabama 1975, is repealed. (b) Act 176 of the 1955 Regular Session (Acts 1955, p. 444) is repealed. Section 4. WHEREAS, at its regular meeting on November 18, 2025, and after a public hearing, the Planning Commission issued its final report and recommendation that the Athens City Council amend Ordinance No. 2017-2016, the Zoning Ordinance of the City of Athens, Alabama (the "Zoning Ordinance") as set forth herein;

WHEREAS, after having received and considered the information from a public hearing, and having fully deliberated these matters, the City Council desires to amend the Zoning Ordinance as set forth herein; and

THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, while in regular session on December 22, 2025, at 4:30 p.m., as follows:

Section 1. The City Council proposes to amend Section 3.8.2 of the Zoning Ordinance of the City of Athens, Alabama, as follows:

3.8.2 Businesses. Businesses shall occupy permanent principal buildings as defined in Article 9. This provision shall not apply to activities in relation to a non-profit organization or event; special events hosted by a business entity lasting no more than 2 days; special events approved by the Mayor; the sale of prepackaged frozen food items; produce stands, provided the stand's location is not deemed unsafe by the Athens Police Department; food truck courts permitted by Special Exception in Industrial Districts; and activities taking place at the Farmers' Market; the sales of tools and related hardware to a business, bv the appointment of and at the location of that business; and mobile food units (to the extent they are otherwise defined and allowed bv other City ordinances). All other mobile business activities are prohibited.

Section 2. The City Council proposes to amend Section 3.9.1.N of the Zoning Ordinance of the City of Athens, Alabama, as follows:

N. Food Truck Court. A food truck court is an area where food trucks may be permanently located and doing business with the general public. Food trucks are permitted within the City only to the extent allowed by other City ordinances, and any food trucks located within food truck courts must comply with those other City ordinances, as well as the provisions of this Ordinance only permitted in designated food truck courts and at special events as indicated in Sec. 3.8.2. Food truck courts must meet the following standards:

1) Must be the subject of an approved site development plan.

2) Must include a minimum of two (2) slips/lots

3) Must have off-street parking to comply with the standards of walk-up restaurants, with each food truck slip/lot counting as a separate walk-up restaurant.

4) Must provide restrooms for customers within a permanent structure.

5) Permanent Utilities connections shall be provided for each slip/lot. Each slip/lot shall be metered separately.

6) All food trucks must meet all requirements of the Limestone County Health Department and the Alabama Department of Health for "Mobile food establishments" (ALABAMA STATE BOARD OF HEALTH BUREAU OF ENVIRONMENTAL SERVICES 420-3-22-.09).

7) The court operator and all food truck operators are required to have a City of Athens Certificate of Occupancy and Business Privilege License.

Proposed Amendments to the Athens Zoning Ordinance

TAKE NOTICE that at the regular meeting of the Athens City Council on December 22, 2025, at 4:30 PM at Athens City Hall, located in the City Council Chambers at 200 W Hobbs Street, Athens, Alabama 35611, there will be a public hearing with respect to the following proposed amendments to the Zoning Ordinance of the City of Athens, Alabama. At such time and place, all persons who desire shall have an opportunity to be heard/submit materials in opposition to or in favor of such proposed ordinance amendments:

WHEREAS, the Planning Commission of the City of Athens, Alabama (the "Commission") proposes that the Athens City Council further amend Ordinance Number 2017-2016 with amendments 2019-2079, 2020-2140, 2021-2058, 2021-2167, 2023-2268, 2023-2298, 2024-2300, 2024-2308, 2024-2309, 2024-2355, the Zoning Ordinance of the City of Athens, Alabama (the "Zoning Ordinance");

WHEREAS, at its regular meeting on November 18, 2025, and after a public hearing, the Planning Commission issued its final report and recommendation that the Athens City Council amend Ordinance No. 2017-2016, the Zoning Ordinance of the City of Athens, Alabama (the "Zoning Ordinance") as set forth herein;

WHEREAS, after having received and considered the information from a public hearing, and having fully deliberated these matters, the City Council desires to amend the Zoning Ordinance as set forth herein; and

THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, while in regular session on December 22, 2025, at 4:30 p.m., as follows:

Section 1. The City Council proposes to amend Section 3.8.2 of the Zoning Ordinance of the City of Athens, Alabama, as follows:

3.8.2 Businesses. Businesses shall occupy permanent principal buildings as defined in Article 9. This provision shall not apply to activities in relation to a non-profit organization or event; special events hosted by a business entity lasting no more than 2 days; special events approved by the Mayor; the sale of prepackaged frozen food items; produce stands, provided the stand's location is not deemed unsafe by the Athens Police Department; food truck courts permitted by Special Exception in Industrial Districts; and activities taking place at the Farmers' Market; the sales of tools and related hardware to a business, bv the appointment of and at the location of that business; and mobile food units (to the extent they are otherwise defined and allowed bv other City ordinances). All other mobile business activities are prohibited.

Section 2. The City Council proposes to amend Section 3.9.1.N of the Zoning Ordinance of the City of Athens, Alabama, as follows:
