IN THE MATTER OF THE ESTATE OF MILDRED WITT CAUDLE
CASE NO. 2025-900432
THIS NOTICE IS HEREBY GIVEN TO THE FOLLOWING PERSONS:
ANY AND ALL UNKNOWN PERSONS WHO ARE AMONG THE LINEAL DESCENDANTS OF LEE ANDER CAUDLE AND SUSIE MINOR CAUDLE, OR THE LINEAL DESCENDANTS OF DEARL EDWARD WITT AND ZELLA PURVIS WITT.
This notice is provided to such persons, whose identity and whereabouts cannot be identified after reasonable diligence, at the direction of the Circuit Court of Limestone County, Alabama.
Mildred Witt Caudle ("Caudle") passed from this life on February 11, 2025. On March 20, 2025, the Probate Court of Limestone County, Alabama admitted Caudle's Last Will and Testament, and Caudle's First Codicil of the Last Will and Testament (collectively referred to herein as the "Will") to Probate and issued Letters Testamentary to E. Shane Black as Personal Representative of Caudle's estate (the "PR"). Caudle's estate is now pending before the Circuit Court of Limestone County, Alabama. Caudle's Will includes certain provisions concerning the lineal descendants of Caudle's parents (Dearl Edward Witt and Zella Purvis Witt) and her spouse, Ford J. Caudle's parents (Lee Ander Caudle and Susie Minor Caudle), on a per stirpes basis.
Upon the petition of the PR, on December 16, 2025, at 9:00 A.M., on the 3rd Floor of the Limestone County Courthouse, 200 W. Washington Street, Athens, Alabama 35611, the Honorable Judge Matthew R. Huggins shall conduct a hearing to determine whether to enter a declaratory judgment establishing that such certain known persons constitute the entire, true, and correct class of the lineal descendants of Caudle's parents (Dearl Edward Witt and Zella Purvis Witt) and her spouse, Ford J. Caudle's parents (Lee Ander Caudle and Susie Minor Caudle), on a per stirpes basis, for purposes of Caudle's Will, and to ascertain the PR's fee with respect to such matter. The Court has appointed Edward L. Alley, Esq., as Guardian ad Litem, to represent the interest of any and all unknown parties who may have any right, title, and/or interest to be a part of such class of persons.
Any such unknown person described above having or claiming an interest in this matter may appear before the Circuit Court of Limestone County, Alabama, at the time and date of the above-described hearing (which is set more than 30 days after the last publication of this notice) to identify themselves and articulate their interest. Any such person may likewise file a pleading or other document with the Circuit Court of Limestone County, Alabama (Attn: Circuit Court Clerk, Limestone County Courthouse, 200 W. Washington Street, Athens, Alabama 35611), in this case identifying themselves and asserting such interest. (Any such persons should also contact the above-referenced Guardian ad Litem with respect to the same, at the following address: 123 N Marion Street, Athens, AL 35611.) If such person does not appear at the hearing, or otherwise respond to the Circuit Court at or prior to the hearing, then the same may not be treated as a part of such aforementioned class for purposes of Caudle's Will.
