AN ORDINANCE TO ZONE +/- 3.68 ACRES (JHH PROPERTIES, LLC) OF PROPERTY LOCATED DIRECTLY NORTH OF HUNTSVILLE BROWNSFERRY ROAD AND DIRECTLY WEST OF U.S. HIGHWAY 31 SOUTH, (PARCEL# 44-10-08-33-0-000-018.000) B-2 (GENERAL BUSINESS DISTRICT) WITHIN THE CORPORATE LIMITS OF THE CITY OF ATHENS.

WHEREAS, the City Council of the City of Athens, Alabama, has heretofore adopted, "The Zoning Ordinance of the City of Athens, Alabama," and,
WHEREAS, the Planning Commission of the City of Athens, Alabama has made a recommendation to the City Council of the City of Athens, Alabama, that the hereinafter described area should be zoned as B-2 (General Business District); and
The City Council of the City of Athens, Alabama, finds that "The Zoning Ordinance of the City of Athens, Alabama," should be amended so as to zone the hereinafter described area as B-2 (General Business District).
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, as follows:
That all of the hereinafter described area or real estate is hereby zoned B-2 (General Business District) in accordance with and defined by "The Zoning Ordinance of the City of Athens, Alabama," and that the area which is zoned as aforesaid is situated in Athens, Limestone County, Alabama, and is more particularly described as follows:
A parcel of land located in the Southwest one quarter of Section 33, Township 3 South, Ronge 4 West Limestone County, Alabama. Said parcel being particularly described as follows:
Commence at found capped rebar stamped Dunivant marking the Northeast corner of the property currently owned by Jesse Matson per Deed Book 2021 Page 28889, said point also lying on the West right of way of US Highway 31; thence run South 00 Degrees 11 Minutes 52 Seconds East long the East line of said Deed Book 2021 found along said West right of way for a distance of 326.14 feet to a found capped rebar stamped Dunivant, said point marking the Northeast corner of the property currently owned by JHH Properties LLC per Deed Book 2019 Page 68820, said point also marking the Southeast corner of said Deed book 2021, said point also marking the POINT OF BEGINNING of the parcel herein described: thence leaving said Deed Book 2021 run South 00 Degrees 11 Minutes 52 Seconds East along said West right of way for a distance of 220.79 feet to a set 5/8 inch capped rebar stomped CA-56OLS; thence run South 54 Degrees 22 Minutes 44 Seconds West along said West right of way for a distance of 76.37 feet to a set 5/8 inch capped rebar stomped CA-56OLS, said point lying on the North right of way of Brownsferry Road; thence leaving the West right of way of US Highway 31 run North 87 Degrees 36 Minutes 50 Seconds West along said North right of way for a distance of 513.09 feet to a set 5/8 inch capped rebar stamped CA-560LS; thence run leaving said North right of way run North 00 Degrees 15 Minutes 34 Seconds West for a distance of 252.75 feet to a found capped rebar, said point being the Northwest corner of said Deed Book 2019 Page 38820; thence run South 89 Degrees 07 Minutes 11 Seconds East along the North line of said Deed Book 2019 Page 38820 for a distance of 575.18 feet to the POINT OF BEGINNING. Said parcel contains 148,231 square feet or 3.40 acres more or less.

A tract of land lying and being in the Southeast Quarter of the Southwest Quarter Of section 33, Township 3 South, Range 4 West, Limestone County, AL and being more particularly described as follows:
Commence at the Southwest comer of said Section 33, being purported as a RR Spike, thence S 89deg. 07' 11" E along the South Boundary of said section 33 a distance of 1987.29 feet to a point; thence leaving said South Boundary, at a right angle, N 00deg. 52' 49" E a distance of 39.83 feet to a Capped Re-bar (illegible) on the North Right-of-Way of Huntsville Browns Ferry Road and being the Southeast corner of that property as described in Deed Book 2021, Page 69285, in the Office of judge of Probate, Limestone County, AL and also being the POINT OF BEGINNING; thence N 89deg. 06' 57" W along the South line of said Deed Book 2021, Page 69285 and the North Right-of-Way a distance of 40.74 feet to a Capped Iron (CA-00279); thence, leaving said North Right-of-Way N 00deg. 15' 18" W a distance of 294.79 feet to a Capped Iron (CA-00279); thence N 89deg. 44' 41" E for a distance of 40.74 feet to o Copped Iron (CA-00279) on, the East line of said Deed Book 2021, Page 69285; thence S 00deg. 15' 19" E along said East line a distance of 252.74 feet to a Capped Iron (CA--00279); thence continue along said East line S 00deg. 14' 31" E a distance of 42.85 feet back to the POINT OF BEGINNING:
