Notice of Pendency of Civil Action
(Lis Pendens)
A. Pursuant to sect.6-6-560, sect.6-6-561, sect.6-6-563, sect.6-6-564, sect.35-4-131 of the Code of Alabama 1975, as last amended, and Rule 4.3 of the Alabama Rules of Civil Procedure, as last amended, notice is hereby given to the following persons and entities (the "Defendants") that on October 17, 2025, Rogelio Lopez ("Plaintiff") filed in the Circuit Court of Limestone County, Alabama, as Civil Action Number CV-2025-900449.00, which is now pending in said Court, a verified Complaint against Defendants:
1. Chue Tou Her, Song Her, Ying Her, Mang Thomas Her and A, B, C, D...X, Y and Z, and their respective heirs or devisees, if deceased, including those who, if known, would be known or suspected to be of unsound mind or to be infants, whose names cannot be ascertained by Plaintiff with certainty, who claim, or may be reputed to claim, Tracts 2, 3, 5, 6, 7 and 8 of Mealer Acres, any title to, interest in, lien or encumbrance thereon, or any part thereof, or any interest therein, whose names, ages, addresses and conditions of mind are unknown to Plaintiff at the time of the filing of this Complaint, but who, when their names and identities are ascertained by Plaintiff, will be added to this Complaint by amendment; and
2. The following described tract or parcel of real property situated and lying and being in the County of Limestone, State of Alabama:
Tracts 2, 3, 5, 6, 7 and 8 of Mealer Acres, according to the final plat of Mealer Acres, of record in the office of the Judge of Probate of Limestone County, Alabama, in Plat Book G, Page 380.
B. The object of the Complaint is to establish the right or title to Tracts 2, 3, 5, 6, 7 and 8 of Mealer Acres and to clear up all doubts or disputes concerning the same.
C. The demand for relief made in the Complaint is to establish that Plaintiff is the owner of Tracts 2, 3, 5, 6, 7 and 8 of Mealer Acres and has a fee simple title thereto, free of, and as against any and all persons and entities, both known and unknown, who claim, or are reputed to claim, Tracts 2, 3, 5, 6, 7 and 8 of Mealer Acres, any title to, interest in, lien or encumbrance thereon, or any part thereof, or any interest therein.
D. PURSUANT TO sect.6-6-565 OF THE CODE OF ALABAMA OF 1975, AS LAST AMENDED, AND TO RULE 4.3 OF THE ALABAMA RULES OF CIVIL PROCEDURE, AS LAST AMENDED, EACH DEFENDANT IS REQUIRED TO ANSWER TO THE ALLEGATIONS OF PLAINTIFF'S COMPLAINT IN THE AFORESAID ACTION WITHIN THIRTY (30) DAYS OF THE LAST PUBLICATION OF THIS NOTICE, WHICH DAY ON OR BEFORE WHICH EACH DEFENDANT MUST ANSWER TO THE ALLEGATIONS OF PLAINTIFF'S COMPLAINT IS THE 12th DAY OF DECEMBER, 2025.
E. FAILURE OF ANY DEFENDANT TO ANSWER TO THE ALLEGATIONS OF PLAINTIFF'S COMPLAINT ON OR BEFORE THE SAID 12th DAY OF DECEMBER, 2025, MAY RESULT IN THE GRANTING OF THE RELIEF REQUESTED BY PLAINTIFF IN HIS COMPLAINT AGAINST SUCH DEFENDANT.
F. Each Defendant's answer to the allegations of Plaintiff's Complaint may be mailed or delivered at any time on or before the 12th day of December, 2025, to Zachary L. Burgreen, attorney for Plaintiff, at the law offices of Alexander, Corder & Shelly P.C., located at 215 South Jefferson Street, (Post Office Box 1129), Athens, Limestone County, Alabama 35611 (35612), and to the Clerk of the Circuit Court of Limestone County, Alabama, Limestone County Courthouse, Athens, Alabama 35611.
G. It is hereby directed that this Notice shall be published in The News Courier, a newspaper of general circulation in Limestone County, Alabama, once a week for four (4) consecutive weeks with the last publication on the 12th day of November, 2025.
H. It is hereby directed that a copy of this Notice of Pendency of Civil Action (Lis Pendens) certified as being a correct, full, genuine and true copy hereof by the Clerk of the Circuit Court of Limestone County, Alabama, shall also be recorded as a lis pendens in the office of the Judge of Probate of Limestone County, Alabama.
