Notice is hereby given that the following Ordinance will be considered by the City Council of the City of Athens, Alabama, at its regular meeting to be held on November 24, 2025, in the Council Chambers of City Hall at 200 W. Hobbs Street, in the City of Athens, Alabama, at 4:30 p.m., and at such time and place, all persons who desire shall have an opportunity of being heard in opposition to or in favor of the following proposed Ordinance.

AN ORDINANCE TO REZONE +/- 2.2 ACRES OF PROPERTY FOR ATHENS GCD, LLC (51%) & DFO ATHENS INVESTMENT, LLC (49%) FROM B-2 (GENERAL BUSINESS DISTRICT) TO C-PUD (CONVENTIONAL PLANNED UNIT DEVELOPMENT). PROPERTY IS LOCATED DIRECTLY SOUTH OF HUNTSVILLE BROWNSFERRY ROAD AND DIRECTLY WEST OF SATURN DRIVE, (PARCEL #: A PORTION OF 44-16-02-04-0-001-002.001) WITHIN THE CORPORATE LIMITS OF THE CITY OF ATHENS.

WHEREAS, the City Council of the City of Athens, Alabama, has heretofore adopted, "The Zoning Ordinance of the City of Athens, Alabama," and,

WHEREAS, the Planning Commission of the City of Athens, Alabama, has made a recommendation to the City Council of the City of Athens, Alabama, that the hereinafter described area should be rezoned from B-2 (General Business District) to C-PUD (Conventional Planned Unit Development).

The City Council of the City of Athens, Alabama, finds that "The Zoning Ordinance of the City of Athens, Alabama," should be amended so as to zone the hereinafter described area as C-PUD (Conventional Planned Unit Development).

NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, as follows:

That all of the hereinafter described area or real estate is hereby zoned C-PUD (Conventional Planned Unit Development) in accordance with and defined by "The Zoning Ordinance of the City of Athens, Alabama," and that the area which is zoned as aforesaid is situated in Athens, Limestone County, Alabama, and is more particularly described as follows:

COMMENCING AT A 5/8" IRON PIN FOUND AT THE SOUTHWEST CORNER OF TRACT 1 ACCORDING TO THE FINAL PLAT FOR EMMA AT ARABELLA VILLAGE, PHASE 1 AS RECORDED IN PLAT BOOK L PAGES 91-93 IN THE OFFICE OF THE JUDGE OF PROBATE FOR LIMESTONE COUNTY, ALABAMA; THENCE RUN SOUTH 72deg.03'30" EAST AT A DISTANCE OF 41.52 FEET TO A FOUND IRON PIN WITH A CAP STAMPED "MORELL" ON THE SOUTHERN BOUNDARY OF SAID TRACT; THENCE RUN ALONG SAID SOUTHERN BOUNDARY WITH A CURVE TO THE RIGHT HAVING A CHORD BEARING OF NORTH 53deg.16'07" EAST, A CHORD LENGTH OF 57.82 FEET, AND A RADIUS OF 50.00 FEET TO THE POINT OF BEGINNING.
THENCE FROM THE POINT OF BEGINNING AND LEAVING SAID SOUTHERN BOUNDARY RUN NORTH 00deg.44'52" EAST AT A DISTANCE OF 120.17 FEET TO A POINT; THENCE RUN SOUTH 76deg.21'58" EAST AT A DISTANCE OF 156.24 FEET TO A POINT; THENCE RUN SOUTH 89deg.15'03" EAST AT A DISTANCE OF 689.77 FEET TO A POINT ON THE WESTERN RIGHT-OF-WAY FOR SATURN DRIVE; THENCE RUN SOUTH 00deg.43'48" WEST ALONG SAID RIGHT-OF-WAY AT A DISTANCE OF 85.48 FEET TO A POINT; THENCE RUN ALONG A CURVE TO THE RIGHT HAVING A CHORD BEARING OF SOUTH 45deg.44'20" WEST, A CHORD LENGTH OF 35.36 FEET, AND A RADIUS OF 25.00 FEET TO A POINT ON SAID SOUTHERN BOUNDARY; THENCE RUN NORTH 89deg.15'08" WEST ALONG SAID SOUTHERN BOUNDARY AT A DISTANCE OF 732.25 FEET TO A POINT; THENCE RUN ALONG SAID SOUTHERN BOUNDARY WITH A CURVE TO THE RIGHT HAVING A CHORD BEARING OF NORTH 72deg.19'54" WEST, A CHORD LENGTH OF 57.74 FEET, AND A RADIUS OF 100.00 FEET TO A POINT; THENCE CONTINUE ALONG SAID SOUTHERN BOUNDARY WITH A CURVE TO THE LEFT HAVING A CHORD BEARING OF NORTH 73deg.28'44" WEST, A CHORD LENGTH OF 30.78 FEET, AND A RADIUS OF 50.00 FEET BACK TO THE POINT OF BEGINNING.
