NOTICE OF FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain promissory note and mortgage executed by CORTEZ INVESTMENTS, LLC, on September 24, 2021 to RONALD HARVILLE and LINDA HARVILLE, and or their successors and assigns, which is recorded in Book 2021, Page 80656, in the Office of the Judge of Probate of Madison County, Alabama, the undersigned, as Mortgagee or Transferee, under and by virtue of the power of sale contained in the said vendors lien deed will sell at public outcry to the highest bidder for cash in front of the main entrance of the Madison County Courthouse in Huntsville, Alabama, on APRIL 24, 2025, during the legal hours of sale the following real estate situated in Mobile County, Alabama, to wit: 1115 Wholesale Avenue NE, Huntsville, Alabama 35811, for which the legal description is recorded in Book 2021, Page 80655 in the Office of Judge of Probate of Madison County, Alabama as follows:
All that part of the Southwest Quarter of Section 18, Township 3 South, Range 1 East of the Huntsville Meridian, Madison County, Alabama and also being a part of Block 1 of the Parkman Industrial Park as recorded in Plat Book 5, Page 94, Probate Records of Madison County, Alabama, particularly described as beginning at an iron stake on the North margin of Wholesale Avenue; said point of true beginning is further described as being due South 1128.7 feet, South 00 degrees 05 minutes East 747.4 feet and north 89 degrees 45 minutes East, 1525.60 feet from the center of the West Boundary of Section 18, Township 3 South, Range 1 East; thence from the point of true beginning North 00 degrees 15 minutes West, 200 feet to an iron stake; thence North 89 degree, 45 minutes East, 62.28 feet to an iron stake; thence South 00 degrees 15 minutes East, 200.0 feet to an iron stake on the North margin of Wholesale Avenue: thence along the North margin of Wholesale Avenue, South 89 degrees 45 minutes West 62.28 feet to the point of beginning.
Together with the hereditaments and appurtenances thereunto belonging, said property will be sold on an "AS IS, WHERE IS" basis subject to the right of way easements and restrictions of record in the Probate Office of Madison County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to the subject property. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
