FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by (i) that certain Mortgage dated March 24, 2022 executed by Orlando Pitts and Tawanda Michelle Pitts ("Mortgagor") to Listerhill Credit Union, which was recorded in the Office of the Judge of Probate of Limestone County, Alabama in RLPY 2022 at Page 29987 (the "Mortgage"), as assigned to Creekwater Capital LLC ("Mortgagee") via that certain Assignment of Note and Mortgage dated February 3, 2026 and recorded in the Office of the Judge of Probate of Limestone County, Alabama in RLPY 2026 at Page 11180 please take notice that the Mortgagee, under and by virtue of the power of sale contained in each Mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Limestone County, Alabama, on the eleventh (11th) day of March, 2026, beginning at 11:00 a.m. the following described real estate (the "Real Estate") situated in Limestone County, Alabama, to-wit:
All that certain lot or parcel of land situated in Limestone County, State of Alabama, and being more particularly described as follows:
A tract of land containing 10.00 acres, more or less, and being situated in the West half of Section 24, Township 3 South, Range 3 West in Limestone County, Alabama, and being more particularly described as follows: Commencing at a magnetic nail at the intersection of the centerline of Dupree-Worthey Road and the South boundary line of said Section 24; thence North 06 degrees 15 minutes 56 seconds West 1,812.78 feet to magnetic nail found at the point of beginning of the herein described tract of land; said point being South 34 degrees 45 minutes 01 seconds East 4,430.76 feet from 5/8 inch rebar at the Northwest corner of said Section 24; thence continue North 06 degrees 15 minutes 56 seconds West 485.00 feet; thence North 88 degrees 27 minutes 22 seconds West 871.84 feet to a capped rebar set and passing through a capped rebar on the West right-of-way margin of said road at a distance of 30.20 feet; thence South 01 degrees 06 minutes 28 seconds West 485.00 feet to a capped rebar set; thence along a fence line South 88 degrees 53 minutes 32 seconds East 315.41 feet; thence South 88 degrees 38 minutes 59 seconds East 618.65 feet back to the point of beginning and passing through a 1/2 inch capped rebar stamped "McElroy" on said margin at a distance of 588.45 feet. Said tract being subject to all easements, rights-of-way, setback lines, restrictive covenants, and encumbrances that may be of record, and the West half of the right-of-way for Dupree-Worthey Road.
All property corners set are 1/2 inch capped rebars stamped PLS 22089.
This sale is made for the purpose of paying the indebtedness secured by the Mortgage and all expenses incident to this sale, including a reasonable attorney's fees.
This property will be sold on an "AS IS, WHERE IS" basis subject to all easements, encumbrances, and exceptions (i) contained in the Mortgage or (ii) otherwise consented to in writing by Mortgagee. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
Payment terms are cash or cashier's check (United States Dollars in immediately available funds) made payable to Mortgagee and delivered to Mortgagee on the date of the public sale.
The Mortgagee reserves the right to bid for and purchase the Real Estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the Mortgage, as provided by the terms of the Mortgage.
