Default having been made of the terms of the loan documents secured by that certain mortgage executed by Merlin J Hines to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Lend-A-Loan LLC, its successors and assigns dated August 15, 2024; said mortgage being recorded on October 9, 2024 in Deed Book 2024, Page 77736 in the Office of the Judge of Probate of Limestone County, Alabama. Said Mortgage was last sold, assigned and transferred to United Wholesale Mortgage, LLC by assignment recorded in Deed Book 2025, Page 71802 in the Office of the Judge of Probate of Limestone County, Alabama.
The undersigned, United Wholesale Mortgage, LLC, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Limestone County, Alabama during the legal hours of sale (between 11am and 4pm), on March 12, 2026 the following property, situated in Limestone County, Alabama, to-wit:
All that certain lot or parcel of land situated in Limestone County, State of Alabama, and being more particularly described as follows: A tract of land lying and being in the Southeast Quarter of the Southeast Quarter of Section 35, Township 3 South, Range 5 West, more particularly described as follows: Beginning at a point on the South boundary of said Section 35, 25 feet West of the Southeast corner of said Section 35; thence continue West along the South boundary of said Section 35; thence continue West along the South boundary of said Section 35 and along the centerline of the Huntsville-Brownsferry Road 150 feet; thence North and parallel with the East boundary of said Section 35, 205 feet; thence East and parallel with the South boundary of said Section 35, 150 feet to a point 25 feet West of the East boundary of said Section 35 and along the West boundary of a county road; thence South and parallel with the East boundary of said Section 35, 205 feet to the point of beginning, containing 0.6 acres, more or less. AND ALSO: A tract of land lying and being in the Southeast Quarter of the Southeast Quarter of Section 35, Township 3 South, Range 5 West, more particularly described as follows: Beginning at an existing railroad spike in the center of Huntsville-Brownsferry Road at the Southeast corner of said Section 35, thence North 89 degrees 31 minutes West along the South boundary of said Section 35 and along the center of Huntsville-Brownsferry Road for a distance of 25.0 feet to a point, said point being the Southeast corner of a tract, thence North 00 degrees 13 minutes West and along the East boundary of the Adams tract and said point being the True Point of Beginning of the tract herein conveyed, thence continue North 00 degrees 13 minutes West for a distance of 50.0 feet to a point, thence North 89 degrees 31 minutes West, a distance of 162.0 feet to a point, thence South 00 degrees 13 minutes East for a distance of 50.0 feet to a point, thence South 89 degrees 31 minutes East and along the North boundary of the Adams tract a distance of 162.0 feet to the point of true beginning.
Subject to all presently existing road rights-of-way, restrictions, and all existing ingress and egress easements, recorded or unrecorded.
Said property is commonly known as 17003 Huntsville Brownsferry Rd, Athens, AL 35611.
Should a conflict arise between the property address and the legal description, the legal description will control.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above.
