NOTICE OF MORTGAGE

FORECLOSURE SALE

Default having been made under the terms of that certain mortgage executed by Binford Farms, LLC, an Alabama limited liability Company on the 22nd day of January, 2025 to First Metro Bank which said mortgage is recorded in the Probate Office of Limestone County, Alabama, in Real Property Book 2025, at Page 5787, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, First Metro Bank will sell at public outcry, for cash, to the highest bidder, before the east entrance of the Courthouse in the City of Athens, Limestone County, Alabama, at 12:00 p.m. or otherwise during the legal hours of sale on July 2, 2025 the following described real estate situated in Limestone County, Alabama, to-wit:

A tract or parcel of land located in the Southwest Quarter of Section 13, Township 3 South, Range 7 West, of the Huntsville Meridian, Limestone County, Alabama, being more particularly described as follows,

Commencing at an existing railroad spike at the Southwest corner of Section 13, Township 3 South, Range 7 West, thence North 00 degrees, 57 minutes, 41 seconds East along the West boundary of said Section 13, a distance of 881.36 feet to a point, the Point of True Beginning of the herein described tract.

THENCE from the Point of Beginning continuing North 00 degrees, 57 minutes, 41 seconds East along the West boundary of said Section 13, a distance of 1065.00 to a point,

THENCE North 89 degrees, 48 minutes, 44 seconds East a distance of 645.44 feet to a 5/8 inch rebar set with plastic cap stamped "RLS 15455 Ronnie G. Coffman," passing a 5/8 inch rebar set with plastic cap stamped "RLS 15455 Ronnie G. Coffman," on the East right of way of Weaver Road (60.00 foot right of way), at a distance of 19.48 feet,


THENCE South 00 degrees, 29 minutes, 48 seconds East a distance of 635.45 feet to a 5/8 inch rebar set with plastic cap stamped "RLS 15455 Ronnie G. Coffman,"

THENCE South 80 degrees, 54 minutes, 16 seconds East a distance of 148.35 feet to a 5/8 inch rebar set with plastic cap stamped "RLS 15455 Ronnie G. Coffman,"

THENCE South 00 degrees, 13 minutes, 33 seconds East a distance of 429.51 feet to a 5/8 inch rebar set with plastic cap stamped "RLS 15455 Ronnie G. Coffman,"

THENCE South 89 degrees, 48 minutes, 44 seconds West a distance of 818.88 feet to the Point of True Beginning, passing a 5/8 inch rebar set with plastic cap stamped "RLS 15455 Ronnie G. Coffman," on the West right of way of Weaver Road at a distance of 781.50 feet, containing 17.576 acres, more or less.

Subject to: That part lying on the West side of the above-described property within the right of way of Weaver Road.

Subject to easements and right of ways recorded or unrecorded.


Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.

Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Limestone County, Alabama, and will be subject to and will be subject to a first mortgage in favor of First Metro Bank outstanding property taxes, and existing special assessments, if any, which might adversely affect the title to subject property.

Said property will be sold on an "As Is, Where Is" basis without warranty or recourse, express or implied as to title, use and/or enjoyment. Neither the mortgagee, nor the officers, directors, attorneys, employees, agents or authorized representative of the mortgagee make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition, including those suggested by Code of Ala. ( 1975) sect.35-4-271, are expressly disclaimed.

Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage. The successful bidder must tender a non-refundable deposit in certified funds made payable to Reynolds, Reynolds & Little, LLC at the time and place of the sale. The balance of the purchase price must be paid in certified funds or by wire transfer by 5:00 p.m. the next business day at the Law Office of Reynolds, Reynolds & Little, LLC at the address indicated below unless prior to said sale Reynolds, Reynolds & Little, LLC has agreed to a later date or closing location. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.

The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Mortgagee, be cause for rejection of the bid, and if the bid is rejected, Mortgagee shall have the option of making the sale to the next highest bidder who is able, capable and willing to comply with the terms thereof.

This sale is subject to postponement or cancellation.
